Contributory Negligence In Auto Accident Cases

North Carolina is a contributory negligence state. This means that if the other driver’s insurance company is able to show that you were even 1 percent at fault for the accident, then you will not be able to recover any compensation for damages such as medical expenses, lost wages, and pain and suffering. For example, if an insurance adjustor can get you to agree that you were speeding, even just a little over the limit, that may be the end of your case, no matter how much at fault the other side was.

Our job as your attorneys is to preserve your rights to compensation. By law in North Carolina, the other side’s insurance adjustor is not allowed to talk with you once you tell him or her that you are represented by a lawyer. In North Carolina, as in many other jurisdictions, once an individual is represented by an attorney, the opposing party (which often includes insurance adjusters) is prohibited from directly communicating with the represented party. This is based on the rules of professional conduct, which are designed to prevent any potential exploitation or unfair advantage that might arise if an unrepresented party were to deal directly with experienced legal professionals or adjusters from the opposing side.

I was falsely accused of a terrible crime that would have ruined my future. During the trial Allen was very prepared, but in addition when the false "victim" testified to some unexpected stuff. Allen was able to come up with a way on the fly to prove the witness was lying. At just the right time he jumped on her in cross-examination, and I was found not guilty!
