Filing medical malpractice lawsuits in North Carolina
Filing a medical malpractice lawsuit in North Carolina is difficult. We are one of the few states that require a certification of your claim by a doctor with the same credentials as your medical provider (known as a 9(j) certification) This expert witness must be familiar with the local hospitals where you received your care and must state in an affidavit that your provider deviated from the standard of care in your case before the case can even be filed.
Due to pressure from medical malpractice insurance companies, local doctors usually refuse to provide a 9(j) certification. This means that our lawyers must seek 9(j) certifications from out-of-state experts, which makes these cases expensive to handle. Many lawyers will refuse to handle medical malpractice cases due to the cost and complexity.
At the Knox Law Center, our lawyers are willing to invest our time and resources in medical malpractice and nursing home neglect cases when we can clearly establish the liability and the malpractice has caused significant damages or wrongful death.
We handle all types of medical negligence cases, including:
• Surgical errors
• Misdiagnosis or delayed diagnosis of illness such as heart attack or cancer
• Birth injuries
• Nursing home abuse and neglect injuries such as bedsores, medication errors, improper use of restraints, malnutrition and dehydration.
